These Terms of Service ("Terms") govern your access to and use of OceanWave Analytics, operated by . By creating an account or using the service, you agree to these Terms. If you are using OceanWave Analytics on behalf of an organisation, you represent that you are authorised to bind that organisation.

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to use OceanWave Analytics.

We offer a 14-day free trial with full access and no credit card required. After the trial, continued use requires a paid plan. We may modify or improve features over time.

Paid plans are billed in advance on a monthly or yearly basis through our payment processor. Plans are priced by monthly event usage; if you exceed your plan, we will ask you to upgrade rather than cutting off your data. You can cancel anytime and will retain access until the end of the current billing period. Except where required by law, payments are non-refundable.

You agree not to:

• Use OceanWave Analytics to collect special-category personal data or to track individuals unlawfully.
• Reverse engineer, resell, or abuse the service or its infrastructure.
• Upload malware, attempt to gain unauthorised access, or disrupt the service.
• Use the service in violation of any applicable law.

You own the analytics data collected for your websites. You grant us the limited rights needed to host and process it to provide the service. We act as a data processor for the visitor analytics you collect; you are responsible for having a lawful basis to collect it (see our GDPR page).

OceanWave Analytics, its software, branding, and content are owned by us and protected by intellectual-property laws. These Terms do not grant you any rights in our brand or technology beyond using the service as intended.

We aim for high availability but do not guarantee the service will be uninterrupted or error-free. We may update, suspend, or discontinue features, and will give reasonable notice of significant changes that affect paid customers.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to others or to our infrastructure.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes will be subject to the courts located in Miami-Dade County, Florida.

We may revise these Terms from time to time. Continued use after changes take effect constitutes acceptance. We will update the “Last updated” date and notify account holders of material changes.
